Mabusth, Building & Zoning Administrator <br />November 13, 1995 <br />SUBJECT: #2078 Jensen Homes, Inc., 405 Tonkawa Road, Class II Preliminary <br />Subdivision - Continuation of Public Hearing <br />Application: The application was tabled at the October meeting of the Planning Commission <br />providing applicant additional time to consult with adjacent property owners concerning their <br />request to acquire additional right-of-way for a future improved road at the southwest comer <br />of the property. Applicant was also asked to confirm area of easement serving the Knight <br />property located at 425 Tonkawa Road. Applicant stated at the meeting that Bennetts are not <br />creating a backlot with this division as the backlot was created years ago at the time of the <br />creation of the driveway easement, refer to Exhibit D (10/15/58). The original code amendment <br />specifically states that lots created prior to January I, 1994 will not be subject to recuirements <br />of this code section. <br />The easement mav remain as an easement as the subdivision regulations do not require the <br />platting of an outlot with this 2 lot division. The Knight property at 425 Tonkawa will <br />continue to have access to a public road to the south and is per code not a backlot. <br />The easement is described at a 30’ width. The area of the easement has been deducted from <br />the total lot area proposed as follows:
