Box 66 <br />Crystal Bay, Minnesota 55323-0066 <br />Re; Ma.\well Bay Access Site <br />Hennepin County <br />\ 1995 <br />Dear Mr. Gaflfon; <br />This is in response to the request of Larry Killien for a letter from me regarding buildiof <br />projects conducted for or on behalf of the Minnesota Department of Natural Resources, an <br />agency of the State of Minnesota, within a governmental subdivision. <br />It is the position of the Department and of this office that the State of Minnesota is not <br />subject to local codes or ordinances except where the Legislature has specifically authorized a <br />local governmental entity to regulate state government activity. This applies whether or not the <br />state is acting directly or through a contractor. As far as I am able to discern, the ordinances o <br />the City of Orono relative to the proposed project by the Department are not applicable. Please <br />see Minn. Stat. § 394.24. subd. 3. <br />In spite of the above-described situation, I know that the Department generally tries to <br />work cooperatively with municipalities to address their respective concerns and needs as <br />construction projects progress. <br />I hope that this information is helpful to you.
