• « <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 8 4 61_____ <br />3.The Orono Plannins Commission reviewed this application on July 18. 1994 and <br />August 15, 1994 and recommended approval of the variance application as <br />amended based on the following unique findings and hardships: <br />A. . SOTr of the total property is unbuildable. <br />B. The original struemre was placed on propeny in 1973 prior to current <br />lakcshore setback standards. <br />C. The majority of the existing house is located within the 0-75 ’ setback area. <br />D The interior lagoon connected to main lake by a dredged channel is <br />considered part of the main lake placing greater setback restrictions on <br />building envelope. <br />E. The current proposal involves decreases in hardcover within the 0-75 ’ and <br />75-250’ setback areas as follows: <br />In the 0-75 ’ setback area there is a 499 s.f. or 1.7% reduction and in the <br />75-250’ setback area there is a 1,889 s.f. or 14% reduction. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicants; and would be in keeping with the spirit and mtent of the <br />Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />reco.mmendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />Page 2 of 6 <br />I.T* *v.»
