(majority of property is located within 0-75 setback area at <br />approximately 29,500 s.f. <br />Description of Request <br />Please refer to the staff memo dated 1-9-95 and the minutes of the meeting for more background <br />on the review of this application. <br />Tlie applicant installed new sections of 6-7’ privacy fence and repaired other sections of fencing <br />without the benefit of a building permit review. At the time of the building permit review prior <br />to construction, staff would have advised of the need for variance approvals. The fencing runs <br />along the channel and adjacent to the County street yard. The Code would allow privacy fencing <br />along the County road or street lot line of the lakeshore lot but the majority of the street yard <br />of this property is located within the 0-75 ’ setback area. In fact, the entire fence is located <br />within the 0-75 ’ setback area. Applicant notes he was completely unaware that a building permit <br />would be necessary to reinstall the fencing. <br />Please review Exhibit A-1 that notes the unique findings and hardships to support the variance <br />request. They are reviewed as followed: <br />1 The Narrows Channel is a heavily trafficked channel connecting the lower lake <br />and the upper lake. There is a need for both a visual and noise buffer from the <br />boat traffic and sounds of boaters that pass through the channel. <br />2. <br />3. <br />4. <br />The channel is heavily trafficked both in the summer by boaters and the winter <br />by snowmobilers. <br />Many private properties along the channel within the City of Orono have similar <br />privacy fencing. <br />Elimination of the fence could potentially result in the reduction of the value of <br />the property.
