hlj /T) ,7 _ <br />ftr ^ Submits a detailed landscape plan showing sufficient planting and <br />landscaping in each of the four years in order to prov ide at the end of the four years a natural screen <br />that will not be less than 50% opaque during the summer months and not less than 25% opaoue in <br />winter. <br />Gr ^ Submits four year planting and landscaping plan which shall provide <br />that in each year of the plan, at least 25% of the necessary landscaping and planting (as determined <br />by the Council as of April 15. 1975 October 1. 1994) be planned, bonded and completed for each <br />required landscaping area according to the other provisions ot this Chapter. The Council may vary' <br />this requirement in order to allow a higher percentage ot the landscaping and planting in any <br />required landscaping area and credit the applicant for the landscaping and planting which otherwise <br />would be required in other landscaping areas. <br />Subd. 15t 18^ Regulations Relating to Location. Construction, Installation-and <br />Maintenance of Docks. Boat Mooring .\reas and Other Fi.x ed or Flooting Stnictures and Objects-on <br />Lakes- Regulation of Strucnires Within the Lake. Adoption by Reference. The City hereby adopts <br />by reference and makes a part of this Chapter as if ftilly set fonh herein, the following: Ordinanc^e <br />No. 1 of the Lake Minnetonka Conservation District as adopted on January 28, 1970; Amendment <br />to Ordinance No. 1 as adopted on May 27. 1970 by the Lake Minnetonka Consorvation District! <br />i\mendment No. 2 to Ordinance No. 1 as -adopted on April 28, 1971, by the Lake Minnetonka <br />Conservat ion Districtr Chanter 11 of the LMCD Code as codified on May 27, 1988 including <br />sections 2.0Q1 through 2.12 and subsequent amendments. The City expressly reserves the right to <br />deny any variance to the provisions of Ordinance Nch-l Chapter II as amended, even though the <br />same variance was granted by the Lake Minnetonka Conservation District. <br />Subd. i&T Reference to Other Ordinances. Sections 10.10 through lO.^d are <br />10.41 is expressly conditioned upon the effectiveness of the Ordinances of the Lake Minnetonka <br />Conser\'ation District pertaining to marina regulations and if all or a portion of such Ordinances are <br />declared invalid by a court of competent jurisdiction, no marina shall have a longer dock, more boat <br />slips or more boat buoys than what was permined by the terms of that ordinance on the date it was <br />declared invalid, or than was last approved by the Lake Minnetonka Conservation District, <br />whichever is less. The City expressly reserves the power to be more restrictive in its regulation <br />than the Lake Minnetonka Conserv ation District Ordinances if the public health, safety and welfare <br />of the citizens of Orono so requires.
