Minnesota Department of Transportation <br />Metropolitan Council <br />5.4. Each party to this Agreement shall appoint one of its members to serve on the <br />Public Education Sub-committee. All written, audio, or video public education materials <br />prepared by t ;y party shall be presented to the Public Education Sub-committee for review <br />and comment prior to their distribution; all educational materials distributed to the public <br />must identify each party to this Agreement as a project sponsor. <br />6, Profect Manager <br />6.1. The MCWD Board of Managers shall be responsible for appointing the Project <br />Manager, to serve at the MCWD’s expense. <br />6.2. The Project Manager shall be responsible for coordinating the implementation of <br />the Project; coordinating communication between the parties to this Agreement; and preparing <br />quarterly progress reports to the Project Advisory Committee. <br />7. Dispute Resolution <br />In the event that disputes arise between the parties with regard to rights and <br />responsibilities under this Agreement, the parties agree to first attempt to resolve the dispute <br />among themselves through discussions between their respective supervisory staff persons. If <br />the dispute caimot be resolved in this manner, it shaU be referred to the Project Advisory <br />Committee for resolution. If the dispute caimot be resolved in this manner, the parties agree <br />to refer the dispute first to mediation and, if not successfully resolved at mediation, to binding <br />arbitration.
