Tho Minnehaha Creek Watershed District (MCWD) has approved a plan for <br />improving the water quality of Long Lake. This plan designates certain property <br />south of County Road 6 in the City of Orono, identiAed in attached Exhibit 1 <br />(hereafter referred to as the "Subj^ Property") as the site for a two-cell wetland <br />detention pond with associated weirs, fish barriers, access roadway and other <br />structures (the "Orono Project"), designates certain other property near Dear Hill <br />Road in the City of Medina as the site for an additional two-cell wetland detention <br />system (the "Medina Project"), and improves two existing detention basins in the <br />City of Long Lake (the "Long Lake Project"). <br />The MCWD conimitted to the ^''Uowing conditions in its agreement with the <br />owners of the Subject Property: <br />a. The MCWD will complete the Medina Project in accordance with the <br />plans included as attached Exhibit 2 prior to beginning the Orono Project. <br />b. The wetland detention basin in the Orono Project shall be located and <br />shall be of the size, volume and shape in strict conformance with the conceptual <br />design set forth in attached Exhibit 3. <br />c The MCWD shall not locate permanently within the Subject Property <br />any equipment, buildings or other structures except the outlet structure identified in <br />Exhibit 3, provided that the MCWD may temporarily locate equipment on the <br />Subject Property for construction or maintenance purposes. <br />d. The access road for maintenance of the wetland detention basin shall <br />be aligned as set forth in Exhibit 3, shall follow the natural grade of the site without <br />excavation or other modification of the existing landscape, and shall have a cleared <br />right-of-way width not exceeding 20 feet, with a natural surface not covered with <br />gravel, rock or impervious surface. <br />f. The wetland detention basin shall be constructed and completed with <br />six months after commencement of construction activities. <br />g. In constructing the Orono Project, and thereafter operating and <br />maintaining it, the MCWD shall require its employees, contractors or agents to use <br />the bes; reasonably available techniques for controlling erosion and for minimizing <br />disruption or damage, either temporary or permanent, to the Subject Property <br />resulting from clearing, grubbing, excavating, damming, ditching or any other <br />construction activities and the equipment and personnel associated therewith. <br />h. After the Orono Project has been initially constructed and/or any <br />operational or maintenance activities thereafter performed, the MCWD shall cause <br />its employees, contractors or agents to employ promptly the best reasonably <br />available techniques for restoring to their original appearance and characteristics any
