J> <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. ^ ^ 8______ <br />cT/; <br />6. <br />7. <br />8. <br />9. <br />10. <br />Tne proposed relocation for storage module wiihm either parking stalls 37 or 38 <br />will place the structure out of the lakeshore setback zones of Doth the City of <br />Orono and the DNR. <br />The location of the storage module at 10’ from the Count>' Road 15 right-of-way <br />where a 50’ setback is normally required, is a location that is extremely visible <br />from said roadway and therefore visual screening of the module by use of <br />eversreen rvpe vegetation is imperative to reduce the negative visual impacts. <br />Based on the intent of Municipal Code Section 10.41, Subdivision 7 (B) required <br />landscape areas shall not be used for the storage of boats, equipment, or <br />materials. The proposed storage module will provide storage such that none of <br />the landscape areas per the approved site plan for this facility need not be <br />encumbered with storage of any kind. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or m.>rt the findings noted above, the Orono City Council <br />hereby grants the variauces as set lo.'ii above and approves the proposed amendment of <br />Resolution 4^3371 that approved the placement of an 8’x8 ’x20 ’ storage module within parking <br />stall 34 and now grants a variance that would allow the relocation of said storage module within <br />either stalls 37 or 38, subject to the following conditions; <br />Page 3 of 9 <br />D -.*
