S 10.09 <br />Subd. 6. Conditicnal Uses: Gran-ing of Permit. <br />A. The Planning Commission may recommend and the <br />Council mav grant a conditional use permit as the use permit was <br />applied for or in modified form, if on the basis of the application <br />and the evidence submitted, the City makes the following findings: <br />1 That the orooosed location ot the <br />conditional use is in acsscd with Che objectives o£ the Zoning <br />Chapter and the purposes of the district in which the si.e is <br />located and Comprehensive Municipal Plan, <br />2 That the orooosed location of the <br />conditional use and the proposedoperated or maintained would not be detrimental to the publiw <br />hHlth, safety or welfare, or materially injurious to properties or <br />improvements in the vicinity; and, <br />3 That the proposed conditional use will <br />comply with each of the applicable provisions of the Zoning <br />Chapter. <br />3. A conditional use permit may be revokable, may <br />be granted for a limited time, or may be granted subject to such <br />conditions as the Council may prescribe. <br />C A conditional use permit shall remain in e..ecw <br />as long as the conditions agreed upon are observed, <br />this Section shall prevent the City from enacting or amending <br />official controls to change the status of conditional uses. <br />D. A certified copy of any conditional use permit <br />shall be filed with the County Recorder or ^^^istrar of Titles o <br />?he county or counties in which the City is located f^r record. <br />The conditional use permit shall include the legal description of <br />rhe property included. <br />Source: City Code <br />Effective Date: 4-1-84 <br />Subd. 7.
