Applicant kept pet <br />within residence and only tethered him in the outside yard when at home. The majority of <br />neighbors in attendance found that the goat presented no problems for them and encouraged the <br />City to grant Mr. Korth the conditional use permit. The area standard was not considered m <br />issue since goat did not graze in the yard area but was considered a house pet and fed special <br />food. There were affidavits from veterinarians and professors at University confirming the goat <br />presented no potential health hazard. <br />Staff would be happy to respond to any questions Planning Commission Members may have <br />concerning the review of this application but in reviewing Resolution #1883, Exhibit 1-6, the <br />conditional use permit was granted by the City for the keeping of a single goat in the LR-1C <br />Zoning District. The City did not address the need for the area variance but specifically granted <br />approval subject to the condition that the City would reserve the right to review and/or modify <br />the conditional use permit if at any time in the future, the maintenance of the pygmy goat is <br />found to be detrimental to the health, safety and public welfare of Orono citizens. The <br />conditional use permit was written specifically for the maintaining of the single pygmy goat <br />based on the fmding that the goat would be maintained as a household pet. <br />Review of Current Application <br />The City has received several complaints involving the subject property concerning baricing <br />dogs (#2) maintained by the owner of the property. The Orono police have bwn working with <br />the owner to attempt to alleviate the problem for the neighbors. The beleating of the pygmy <br />goat is a concern of an adjacent neighbor (south) who receives the most impact from the outdoor <br />kennel where goal is maintained. This is especially objectionable in the summer months when <br />windows are open. Review Exhibit G, note the kennel is approximately 5’ from the extended <br />side lot line. Section 5.36. Subd. 2(C) would require a minimum 30’ setback from the side or <br />rear yard. The entire outdoor 17 ’xl7 ’ kennel is located within the property to the east. It is <br />staffs understanding that the owner has received permission from Mr. Pearce to maintain the <br />kennel in its present location.
