MIHOTBS OF THE PLANIIIBG COMMISSION MBBTIliG H1CTJ> SEPTEMBER 8, 1987 <br />•1191 MED, IMC. <br />2220/2235 PREMCH CREEK CIRCLE <br />AFTEk-THE-PACT CONDITIONAL OSB PERMIT <br />PUBLIC HEARING 9:37 - 9:45 <br />The Affidavit of Publication and Certificate of Mailing were <br />noted. <br />Mr. Edward Dayton and Mr. Ed Zimmerman, representing Gary <br />Carlson, were present. <br />Building & Zoning Administrator Mabusth explained that the <br />berm was created sometime around the final grading for the <br />subdivision. It was placed within the residential pads where <br />the City had not approved any kind of land alteration. It <br />did affect the septic site for Lot 5, however, there was <br />additional land available for a new site. Staff discovered <br />the berm after members of the Crystal Bay neighborhood <br />brought it to the attention of staff. <br />Mr. Dayton stated that the berm was discussed at the public <br />hearing in the spring of 1984 and after the berm was <br />constructed, a staff member walked the site and sugaested <br />alterations to the south end and the right-hand side because <br />there is a City draintile that comes down and drains the <br />water off Briar Street in one of the ponds and the berm was <br />extending over that particular draintile. The berm was moved <br />back to accommodate this request. <br />Frank and Barbara Yessup, owners of Lot 5, noted that they <br />would like the berm to be leveled off so as not to look like <br />just a bump. <br />Mr. Dayton explained that Mr. & Mrs. Yessup wish to extend <br />the berm further to the north and implement it within their <br />landscape plan. <br />Acting Chairtiian Bellows insisted that the berm be properly <br />maintained as it has become very overgrown with weeds. <br />There were no other comments from the public. <br />It was moved by Cohen, seconded by Johnson, to approve <br />application #1191 for NED, Inc. or subsequent purchasers for <br />an after-the-fact conditional use permit for a berm placed on <br />Lots 5 and 6, French Creek, subject to the following <br />conditions: <br />1. Berm not to exceed the height of 5*6". <br />2. Any subsequent work or extention of that berm be <br />subject to the approval of the proper City authorities. <br />3. Proper maintenance of berm under <br />ordinances by the owners of the property. <br />Motion, Ayes 5, Nays 0. <br />current City
