The special conditions applying to the structure or land in question are peculiar to such <br />property or immediately adjoining property. <br />Response: The conditions of the property, including the septic system, limiting setbacks, vegetation, <br />and topography are unique to the property. <br />9. The conditions do not apply generally to other land or structures in the district in which <br />said land is located. <br />Response: Setbacks are intended to provide a framework for what can be built, and it is uncommon <br />for the setbacks in combination with a septic system to be so limiting that a reasonable buildable area <br />does not exist, as is the case on this property. <br />10. The granting of the application is necessary for the preservation and enjoyment of a <br />substantial property right of the applicant. <br />Response: It is the substantial property right of an individual to be able to use a property in a <br />manner consistent with how it is intended to be used and how it has historically been used. By not <br />granting the variance, the use of the property would be highly substandard. <br />11. The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to the intent of the Zoning Code. <br />Response: Granting this variance is in compliance with the intent of the Zoning Code in every way, <br />including in consideration of the health, safety, comfort, and morals of the zoning code. <br />12.
