CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 728 4 <br />FINDINGS OF FACT: <br />1. This application was reviewed as Zoning File #LA22-000041. The analysis contained <br />within staff memos and the exhibits attached to the aforesaid memos, all minutes from <br />the above mentioned meetings, and any and all other materials distributed at these <br />meetings are hereby incorporated by reference. <br />2. The Property is subject to a concurrent boundary line adjustment request to combine the <br />Property with the southern portion of the property at 2987 Casco Point Road, thereby <br />enlarging it. <br />3. The Property is located in the LR -1C Zoning District. <br />4. The Property contains 53,432 square feet (1.2 acres) in area and has a defined lot width <br />of 132.8 feet at the OHWL and 144 feet at the 75 -foot setback. <br />5. The Property is within Tier 1 and hardcover is limited to 25% according to the <br />Stormwater Quality Overlay District. <br />6. Applicant has applied for the following variance: <br />a. Average Lakeshore Setback Variance <br />7. In considering this application for variance, the Council has considered the advice and <br />recommendation of the Planning Commission and the effect of the proposed variance <br />upon the health, safety and welfare of the community, existing and anticipated traffic <br />conditions, light and air, danger of fire, risk to the public safety, and the effect on values <br />of property in the surrounding area. <br />ANALYSIS: <br />"Variances shall only be permitted when they are in harmony with the general purposes <br />and intent of the ordinance ...." The lot includes difficulties in the orientation of the <br />shoreline and location of adjacent lots/homes. The proposed home location allows for <br />greater stormwater management opportunities on the street side of the Property. The <br />proposed home footprint and mass will allow for preservation of the lake views of the <br />property to the south. The location of the home will limit the lakeward building extent on <br />the property to the north, which will help to improve lake views currently enjoyed by the <br />owners of 2975 Casco Point Road. The proposed variance is in harmony with the <br />purpose of the Ordinance. <br />
