Kelley asked how difficult it w.-suld bo to haul <br />all of the soil off of the property and bring in clean soil? Mr. <br />Ronnei stated that it would be very difficult to proceed witn <br />such a project. The soil would have to be incinera ed. Once the <br />soil is incinerated, disposal would still be required. The <br />chemical that is being used to clean the soil is" similar to <br />rubbing alcohol and will volotize as soon as it is exposed to the <br />air. Kelley asked how the City felt about this process. <br />Zoning Administrator Mabusth stated that tne City had no <br />problem with the proposed process. She had been in contact with <br />the PCA's Hazardous Material Division and Air Quality Division <br />and they will be working on that phase of the application. They <br />in turn will work with the City of Orono. Mabusth stated that <br />she was still awaiting more information from the City Engineer <br />concerning phase two. Mabusth recommended tabling that portion <br />of the project. <br />There were no comments from the public regarding this matter <br />and the public hearing was closed. <br />It was moved by Planning Commission member Brown, seconded <br />by Planning Commission member Moos, to recommend approval of the <br />conditional use permit for land alteration. VAUGHAN & TODD ZIBSMER <br />3440 BAT8IDE ROAD <br />VARIANCE <br />PUBLIC HEARING 9:46 P.M. - 9:50 P.M. <br />The Affidavit of Publication and Certificate of Mailing were <br />duly noted. <br />Mr. Todd Ziesmer was present for this matter. <br />Assistant Planning and Zoning Administrator Gaffron <br />explained that the applicants were seeking a lot width variance <br />to construct a new residence. The property area is approximately <br />2.3 acres. There was a pre-existing house that was demolished. <br />Applicants are proposing to locate the new house where the old <br />structure stood. The existing lot width is 118' where 200' is <br />required, so applicants would require an 82' variance. Chairman <br />Kelley asked whether there was an adequate building envelope. <br />Gaffron replied that it would leave the required 30' side <br />setbacks. <br />Mr. Robert Anderson, a neighbor to the east of applicants' <br />property, stated that he had concern about the house interfering <br />with his view of Stubbs Bay. He had contacted Mr. Ziesmer and <br />discussed this concern. Mr. Ziesmer had indicated that he may be <br />willing to move the house back 15'. Kelley asked if a lakeshore <br />setback would be a concern. Gaffron responded that this property
