Zoning Administrator Mabusth stated that the City <br />would not want people parking on Crystal Bay Road. Gaffron added <br />that there was limited parking area located in the rear access. <br />Planning Commission member Cohen asked for clarification <br />about the 33* easement for public highways at the rear of the <br />property. Gaffron explained the history of the easement and <br />added that there remains a question as to whether the easement <br />was ever actually created or not. A Proceeding Subsequent may be <br />necessary to clear this flaw in the Schibilla's title. Mr. <br />Schibilla stated that he had been in touch with Minnesota Title <br />to attempt to remedy this problem. They indicated that this <br />easement does not show on either of the adjacent properties. The <br />easement is not continuous and only pertains to the Schibilla <br />property. <br />There were no comments from the public regarding this matter <br />and the public hearing was closed. <br />It was moved by Planning Commission member Cohen, seconded <br />by Planning Commission member Hanson, to recommend approval of <br />the proposed garage location, and hardcover variance, subject to <br />the easement issue being resolved before the building permit for <br />the garage is issued. Mr. Schilbilla asked if Cohen could re <br />word his motion. He was not certain as to the time frame <br />involved with resolving the easement issue. He was granted <br />federal funds because of the storm damage for rebuilding the <br />garage. There was a time limit involved with the availability of <br />those funds. Gaffron and Cohen concurred that the status of the <br />easement would have to be determined before a building permit <br />could be issued. Gaffron inquired as to what structural area the <br />motion recommended. Kelley stated that the motion recommended <br />approving structural area of 1264*. The hardship in this matter <br />is the fact that the applicants' previous garage was destroyed in <br />a storm. Planning Commission member Brown added that the motion <br />should also include language prohibiting the conversion of the <br />extra level of the garage into a dwelling. Kelley added that no <br />additional hardcover could be placed on the property in the <br />future.
