The original application involved a two story addition at <br />the lake side of the residence involving a major encroachment of the average <br />lakeshorc setback line. The neighbor to the east was in complete opposition to <br />the improvement because of the impact upon the views from his view windows <br />at the south and west. The applicant was advised of the hardcover and structural <br />coverage limits for t!ie property and was further advised by Planning <br />Commission to consider more comprehensive needs of the property as property <br />lacked a garage. The applicant has filed an amended variance application <br />requesting a detached garage, grade level patio at the lakeside and second level <br />deck at the southwest comer of residence. The following ordinances are <br />pertinent for this review: <br />1.Section 10.03, Subd. 14 (C) - Structural coverage variance. <br />Total area = 13,747.5 s.f. <br />Allowed = 2,062.2 s.f. or 15% <br />Existing = 1,588.9 s.f. or 10.8% <br />Proposed = 2,165.5 s.f. or 15.7%* <br />Variance = 103.3 s.f. or 0.7% <br />* House/porch 1,328.9 s.f., boathouse 160 s.f., second level deck 88 <br />s.f., detached garage 576 s.f, upper level deck detached garage 12.25 s.f <br />2.Section 10.22, Subd. I (B) - Average lakeshore setback review. Refer <br />to Exhibit E. The grade level patio that extends beyond the average <br />lakeshore setback line is not considered an encroachment. There is no <br />variance sought by applicant to the average lakeshore setback. <br />3.Section 10.22, Subd. 2 - Review of hardcover. <br />A. 0-75' setback area = 5,437.5 s.f. <br />Allowed = 0 <br />Existing = 380 s.f or 6.9% <br />No changes are proposed within the 0-75' setback area.
