Of:- k'^ <br />A- i V <br />I CITY <br />I OF <br />I ORONO <br />City of OROIVO <br />RESOLUTION OF THE CITvIiic^cilil^ HAS BEEN <br />—I^ROFIIMEDNO. 2006 <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 <br />PILE #1023 <br />WHEREAS, Rolla and Nancy Martin (hereinafter "the <br />applicants") arc the owners of the property located at 2675 Shadywood <br />Road within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Tract A, Registered Land Survey No. 1453, files of Registrar of <br />Titles, Hennepin County, Minnesota, (hereinafter "property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.22, Subdivision 2 to <br />permit the construction of a room addition which will increase hard <br />cover in the 75-250* lalceshore setback zone from 26.8% to 27.1% where <br />a maximum of 25% hardcover is normally allowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1023. <br />2. The property is located in the LR-IB Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />May 19, 1986, and recommended approval of the proposed variance <br />based upon the following findings; <br />A) Applicant has 0% hardcover in the 0-75* setback zone. <br />B) No existing hardcover on the property is readily <br />available for concurrent removal as a tradeoff. <br />4. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the applicant and the effect <br />of the proposed variance on the health, safety and welfare of the <br />community. <br />Page 1 of 3
