Chuck Dovt-ney <br />August 22,1996 <br />Page 2 <br />5.Martin then asked for the application to be tabled before it was reviewed by the <br />Planning Contmission, because he decided to sell the house. He never re-opened the <br />application and the issues of the excess hardcover and gazebo setback were never <br />resolved. <br />At this point I suggest the following course of action: <br />a. Have the surveyor (presumably Gronberg, who has all the basic work done in prior <br />surveys) do a hardcover w orksheet for the site to confirm the level of hardcover in 1996. <br />b. If 75-250 ’ hardcover is over 7,890 s.f, your options are: <br />1. Remove the excess hardcover, QE. <br />2. Apply for a hardcover variance, i.e. re-a:tivate Martin's application. <br />c. If 75-250' hardcover is 7,890 s.f. or less, then the only issue is whether the gazebo is at <br />least 10* from the house. It would be appropriate for the Building Inspector to review^ <br />w hether the gazebo might be considered as part of the house structure, which would negate <br />this issue. If, however, he considers it as a separate accessor}' building, it must meet the 10' <br />setback. If it doesn ’t, your options are: <br />1. Move it to a legal location that meets 10',_QK <br />2. .‘^pply for a structure-to-structure setback variance <br />Fm enclosing the documentation on this issue, and will be pleased to answer any further questions <br />you may have.
