He said that he had <br />not applied for the building permit and just assumed that <br />dirt would be excavated away from the foundation and the swale <br />would be used for drainage He said that a reading with a <br />transit indicated the need tc cut an additional 6" to 12" nearer <br />the house to enable drainage to occur. It was necessary to take <br />that same additional cut near the lake. <br />There were no comments from the public regarding this matter <br />and the public hearing was closed. <br />It was moved by Chairman Kelley, seconded by Planning <br />Commissioner Hanson, to recommend approval of the after-the-fact <br />conditional use permit, the hardship being the need to relieve <br />runoff concerns on the other side of the house. Chairman Kelley <br />questioned whether the City should take a drainage easement <br />across this property? Gaffron said that he could look into that <br />aspect. Kelley amended his motion to Include direction to staff <br />to look into the dedication of a drainage easement and make a <br />recommendation to the City Council, Hanson seconded. TO 9:40 P.M. <br />The Affidavit of Publication and Certificate of Mailing were <br />duly noted. <br />Hr. and Mrs. Parten were present for this public hearing. <br />Assistant Planning and Zoning Administrator Gaffron provided <br />a brief history regarding this application for a 3-lot <br />subdivision. <br />Chairman Kelley questioned whether it would be possible to <br />split Outlot A into two outlots. One portion would end in the <br />northeast corner with a cul-de-sac and Outlot B would serve the <br />two lots in the back. Because Outlot B would serve only two <br />lots, it could remain a dirt road. Kelley said that the issue to <br />him is serving the lots to the east as well. <br />Mr. Parten asked Gaffron to shew the Planning Commission the <br />proposal for a 2-Lot subdivision. <br />Planning Commissioner Bellows asked where the septic system <br />is located for Lot 1? <br />Gaffron indicated that the alternate site is still located <br />in Outlot A and the 60' easement creates a configuration for Lot <br />1 so that it is not contiguous with Outlot A.
