The southern 4’ of the original 40’ dedicated right-of-way has <br />already been vacated. There is no record of a document number so staff has been unable to <br />determine the year of the vacation. The legal description for 300 Crestview Avenue provides <br />no references to the earlier vacation. <br />The Public Works Director has been asked to review’ the proposed vacation and has advised <br />applicant to proceed with the vacation finding no current or fuUire public use for the 36’ right- <br />of-way. Municipal sewer lines are not located within the unimproved right-of-way. The <br />applicant's surveyor is reviewing the proposed vacation with various utility companies to <br />determine the need for utility easements. The Public Works Director w’ill ask for the dedication <br />of a drainage and utility easement in exchange for the vacation. Property owners on either side <br />shall determine the appropriate location for the drainage and utility easement.
