1^. <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO <br />5.The City Council finds that the conditions existing on this propert>’ are peculiar <br />to it and do not apply generally to other property in this zoning distnct; that <br />erantina the variance 'vould not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessar>' to alleviate a <br />demonstrable hardship or difficulty; is necessary’ to preserve a substantial property <br />right of the applicants; and would be in keeping with the spint and mtent of thv <br />Zoning Code and Comprehensive Plan of the City. <br />CONXLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above fmdings, the Otono “ m n/™h <br />grants variances to Municipal Zoning Code Sections 10.22, Subdms.ons 1 (B) arrf * to pemil <br />fhe construction of a two story entry addition, a second story den addition <br />InVr totallation of a 5’ x 3' landing and spiral staircase at the lakeside of the residence, <br />subject to the following conditions; <br />1.Authorities granted by this variance run with the property not with the applicants, <br />but atr^r^Tssive onlv and must be exercised by application for a buildmg <br />poJr^t wS one year' of the date of Council approval, or this variance wiU <br />expire on that date (May 10, 1994). <br />2.Violation of or non-compliance with any of the terms and of ^ <br />resolution shall constitute a violation of the zomng code, shall automatical!) <br />[eminate any authority granted herein, and shall be punishable as a misdemeanor. <br />3.The undersigned applicants have read, understood and hereby agree terms <br />I^SiTstsolmion and on behalf of themselves, their <br />hereby agree to the recording of this resolution m the cham of title <br />property. <br />Page 3 of 5
