TO:Ron Moorsc, City Administrator <br />FROM:John Gcrhardson, Public Works Director <br />DATE:December 18, 1995 <br />SUBJECT: Driveway Encroachment 3860 North Shore Drive <br />During the summer of 1996,1 received a call from a realtor regarding the driveway location at 3860 <br />North Shore Drive. It seems that over the years there has been encroachment onto adjoining City <br />property for the driveway at the above address. <br />Considerable landscaping has been performed and the new owner is requesting an easement from <br />the City to leave the driveway where it is. <br />In my discussions with the realtor, I indicated that because the City acquired the property through <br />tax forfeiture through Hennepin County, the City is restricted as to what can be done with the <br />property. We do not have the authority to grant an casement becau i the property was acquired to <br />be used as a drainage and conservation area. <br />We have an official request from the new owner to take whatever stops are necessary to grant them <br />an easement. <br />The following are the procedures we would have to follow to allow the driveway to stay where it is; <br />1. The City must reconvey the property back to Hermepin County by resolution that <br />states the property or part of the property is to be sold to an adjoining property <br />owner. <br />2.Hennepin County would place a value on the property and if the property owner <br />agreed with the price, it would be a done deal. <br />The other option would be to have the current property owner move the driveway off of City <br />property. An amount was escrowed during the closing to do this in the event an easement or sale <br />could not be accomplished. <br />m <br />i <br />-L ' J'
