�.p.AT^ CITY OF ORONO !, <br /> RESOLUTION OF THE CITY COUNCIL <br /> 1. <br /> i\j111L- <br /> G�� NO. 7396 <br /> t'.kEs Homo''' <br /> A RESOLUTION <br /> AMENDING RESOLUTION NO. 7382 <br /> WHICH GRANTS A VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-420 <br /> FILE NO. LA23-000024 <br /> WHEREAS, on May 16, 2023, Kevin Revering and Sarah Revering, a married couple, <br /> (hereinafter the"Applicants"), applied for a variance from the City Code for the property addressed <br /> 1960 Fox Ridge Road and legally described as: <br /> Lot 7, Block 1, Fox Ridge, Hennepin County, Minnesota (hereinafter the"Property"); <br /> WHEREAS, on July 10, 2023 via Resolution No. 7382, the Applicants received approval <br /> of a front yard setback variance from Orono Municipal Zoning Code Section 78-420 to allow a <br /> garage addition 46 feet from the front property line where a 50-foot setback is required and a <br /> 56.9-foot setback currently exists; and <br /> WHEREAS, the Applicants have requested an amendment to Resolution No. 7382 <br /> regarding a minor modification to the approved plans reflecting a setback of 44.9 feet from the <br /> lot line where a 46-foot setback was previously approved; <br /> WHEREAS, The Applicants' proposed addition did not change dimensions or location, <br /> however an annotated site plan was submitted for the variance approval. The updated survey <br /> more accurately depicts the property lines and setback to-scale; and <br /> WHEREAS, the City Council's decision was based on the findings and recommendation <br /> of the Planning Commission, reports by City staff, comments from the Applicant and the public, <br /> and the effect of the proposed variance on the health, safety, and welfare of the community as <br /> well as the impact on the properties in the vicinity. <br /> NOW THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br /> hereby approves the amended plans attached as Exhibit A. <br /> CONCLUSIONS, ORDER AND CONDITIONS: <br /> C1.The original approvals granted with Resolution No. 7382 remain in place. The approved <br /> project shall conform to the attached, revised plans submitted by the Applicants and <br /> annotated by City staff, attached to this Resolution as Exhibits A & B. <br /> 1 <br />
