The proposal as dnigpied <br />results in a lot configuration that meets the definition of a frontback lot subdivision. <br />The definition of "back lot" per Section 10.02 and Section 11.03, Subd. 2 is "a lot <br />typically separated from a public or private road by another lot and which gains access <br />to the public or private road via a narrow corridor. Such a separated lot is consider^ <br />to be a 'back lot’ when the corridor is platted as an outlot. A separated lot is <br />considered to be a 'flag lot' when the corridor is platted as part of the lot. When the <br />corridor is merely an easement over another lot, the separated lot is considered to be <br />an 'easement back lot’". Section 11.30, Subd. 5(C) states that flag lots and easement <br />back lots as defined in this chapter sh.^H not be created. Therefore, the proposed lot <br />line rearrangement must make use of an outlot per the provisions of Section 11.30, <br />Subd. 5(C). (See Exhibit 1) <br />4.Section 11.10, Subd. 14(A)- "A. Zoning Regulations. Every plat shall conform to <br />existing zoning regulations and subdivision regulations applicable at the time of Final <br />Plat Approval. Variances shall not be approved to increase the overall subdivision <br />density above the minimum lot area requirements of the applicable zoning district and <br />this chapter." <br />Pertinent Facts <br />1.The property at 372 Westlake Street is owned by Dean Maeser and consists of three tax <br />parcels as follows: <br />Lot 10 = 50’ X 544* = 27,200 s.f. = 0.62 acre <br />Lot 11 = 71.16’ X 519’ = 36,900 s.f. = 0.85 acre <br />Lot 12 = 49’ X 462 ’ = 22,653 s.f. = 0*52 acre <br />Total I -99 acre <br />Lot 10 contains the majority of the driveway and 2/3 of the existing principal residence <br />structure. <br />3.Lot 11 contains 1/3 of the existing principal residence struemre; a second "house" used <br />only for storage; and small comers of two rental cabins. <br />4.
