A copy of that section is <br />attached. <br />An ice arena is not specifically mentioned as a <br />use oualified for a conditional use permit under any of the <br />provisions under Subdivision 3, although several of the <br />provisions come very close or contemplate similar <br />structures: <br />the arena will be built on land leased for a <br />long term from the School District and the <br />school District will be heavily involved in <br />the arena’s operation, which comes close to <br />qualifying the arena under Subdivision 3(A). <br />We understand from the City Attorney, though, <br />that the private ownership of the arena <br />building itself technically disqualifies the <br />use from this category. <br />subdivision 3(C) covers “country clubs, <br />tennis clubs ... or private non-profit parks, <br />playgrounds or other similar uses".
