The structure will not be separated from the High School by a public road. <br />D.The facility shall be owned by a non-profit organization under a lease agreement with <br />the School District. Review page 1 of Terms of Lease Agreement, Exhibit C, the <br />non-profit organization will be a newly fonned Minnesota non-profit corporation that <br />will maintain Section 501 (C-3) status specially as a supporting organization to the <br />Orono Hockey Boosters Inc. <br />E.Applicant shall demonstrate financial ctqjability to complete construction of facility. <br />Applicant has confirmed that they have collected $1,625,000 in cash and hard <br />pledges, review Exhibit B, page I. Refer to Exhibit C, the School District would <br />provide Orono Hockey Boosters with an additional $175,000 bringing the total of <br />committed of funds received to $1,800,000 or 83% meeting the required 80% of <br />committed funds. The City Council shall decide how they wish the financial <br />confirmation to be made. <br />Section 10.61, Subd. 2(A-3) - Use is permitted as a conditional use permit in a residential <br />zoning district Such uses are permitted 12 s.f. of signage. Applicant should provide more <br />detail information on their signage needs as a variance may need to be granted. Such signage <br />will be limited to an 8' height at a minimum 5' setback from lot line. <br />Section 10.61, Subd. 5(A) - Exterior parking setback variance. <br />A.
