4) <br />A RESOLUTION VACATING <br />AN UNIMPROVED ALLEY WITHIN THE PLAT OF <br />OTTOVILLE ON LAKE MINNETONKA <br />IN THE CITY OF ORONO, <br />HENNEPIN COUNTY, MINNESOTA <br />FILE NO. 2088 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State wf Minnesota; and <br />WHEREAS, on October 31, 1995, Steven A. Gardiner (hereinafter the <br />"£^)plicant") filed a petition with the City of Orono requesting the vacation of an unimproved <br />public right-of-way adjacent to his property originally dedicated in the plat of Ottoville on Lake <br />Miruietonka, Hennepin County, Minnesota in 1887 and legally described as follows. <br />that part of alley adjacent to Lots 2 and 3 dedicated in the plat of <br />Ottovihe on Lake Mirmetonka lying southerly of the westerly extension <br />of north line of said Lot 2 and northerly of the northwesterly right-of- <br />way line of County Road 84 (AKA Bayside Road) according to the <br />recorded plat thereof, Hennepin County, Mirmesota; and <br />WHEREAS, after due published and posted notice, public hearings were held <br />before the City's Planning Commission on November 20, 1995 and January 16, 1996 regarding <br />said vacation and all interested persons were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the Plaiming Commission <br />recommended unanimous approval of the proposed vacation; and <br />WHEREAS, the City Council of the City of Orono finds that said vacation as <br />t-roposed is in keeping with the public interest and in consideration of the following findings: <br />1.The right-of-way as it exists today will not serve for public road use based on <br />tho pattern of residential development and access to adjacent properties. <br />2.
