ORDINANCE NO., SECOND SERIES <br />sly 3 <br />and <br />2Sm& <br />mine <br />;s) <br />Eince') <br />AN ORDINANCE AMENDING THE ORONO MUNICIPAL CODE ’ <br />BY ADDING TREE PRESERVATION REQUIREMENTS <br />The City Council of the City of Orono ordains: <br />Section I. The Municipal Zoning Code of the City of Orono, Minnesota is amended by adding <br />Section 10.57, Tree Preserv'ation, as follows: <br />Section 10.57. Tree Preservation. <br />Subd. 1. Purpose. It is the policy of the City of Orono to recognize and preserve <br />existing natural resources of the community. Northern Orono is characterized by its rural <br />vistas interspersed with woodlands, and southern Orono by its miles of wooded Lake <br />Minnetonka shoreline. The City finds that its trees and woodlands provide numerous benefits <br />including, but not limited to: stabilization of the soil by the prevention of erosion and <br />sedimentation, reduction of storm water runoff, improvement of air quality, reduction of <br />noise pollution, control of urban heat island effect, protection and increase of property values <br />pmtecuon of privacy, energy conservation through natural insulation, providing habitat foi^ <br />birds and other wildlife, and conser\ation and enhancement of the city ’s physical and <br />aestheuc environment. The purpose of this policy is to preserv e and protect significant trees, <br />stands of trees and wooded buffer areas, the loss of w hich as a result of land disturbances <br />associated with the process of development or construction would adversely affect the <br />character of the City and the integrity and quality of its development. This policy also <br />recogmzes that, despite the best efforts of the City and property owners, trees may <br />occasionally be lost in the development or construction process. In those cases tree <br />replacement or reforestation shall be required. <br />Subd. 2. Regulations. In furtherance of the puipose of this section, the City Council <br />shall by resolution adopt and may, from time-to-time, amend resolutions providing for tree <br />preservation and replacement in situations involving development or construction. <br />1 Enforcement. Failure to comply with the provisions of such <br />regulations rhall constitute a violation of this Ordinance and the Zoning Code. <br />M^publLtb^n Publication.
