EXISTING SUBDIVISION CODE - TREE PRESERVATION STANDARDS <br />Current Code Wording: <br />SEC. 11.03 DEFINITIONS. <br />Subd. 2. Def. #58. "Shade Trees" - A tree of approved species and size. <br />SEC. 11.10 SUBDIVISION APPLICATION. <br />Subd. 10 (C) Class III Subdivisions. Complete Cla.ss III Preliminar>’ Plat <br />applications shall include the following: ...; (8) a vegetation preservation and protection plan;... <br />SEC. 11.60 PRESERVATION Of NATURAI. FEATURES AND AMENITIES. <br />Subd. 1. General. Existing features which would add value to residential <br />development or to the City as a whole, such as trees, as herein defined, watercourses and falls, <br />beaches, historic spots, and similar irreplaceable assets, shall be preserved in the design of the <br />subdivision. No trees shall be removed from any subdivision nor any change of the grade of the <br />land effected until approval of the preliminary subdivision has been granted. All trees on the <br />subdivision plan to be preserved, and all trees where required shall be welled and protected against <br />change of grade. The vegetation map shall show the number and location of existing trees, as <br />required by this Chapter and shall further indicate all those marked for retention, and the location <br />of all proposed shade trees required along the street side of each lot as required by these regulations. <br />Subd. 2. Shade Trees Planted by Subdivider. <br />A. As a requirement of subdivision approval, the City may require that <br />subdivider plant shade trees on the property of the subdivision. Such trees are to be planted within <br />five (5) feet of the right-of-way of the road or roads within and abutting the subdivision, or, at the <br />discretion of the City, within the right-of-way of such roads. One (i) tree shall be planted for every <br />forty (40) feet of frontage along each road unless the Council, upon recommendation of the City staff <br />shall grant a waiver. <br />B. New trees to be provided pursuant to this Chapter shall be approved by <br />the City and shall be planted in accordance with the specif.cations of the City, such trees shall have <br />a minimum trunk diameter (measured twelve (12) inches above ground level) of not less than two <br />(2) inches. Only Oak, Honey Locust, Hard Maples, Ginkgo, Ash or other long-lived shade trees, <br />acceptable to the City shall be planted.
