r <br />STATEMENT OF HARDSHIP ^ *• <br />- i'9 <br />The City Code states that a variance may be granted from the literal provisions of the <br />ordinance in instances where strict enforcement would cause undue hardship because of <br />circumsUnces unique to the individnal property under consideration and when it is <br />demonstrated that such actions would be consbtent with the spirit and intent of the ordinance. <br />Undue hardship means the property in question cannot be put to reasonable use if used under <br />conditions allowed by this ordinance, the plight of the landowner is due to circumstances <br />unique to the property not created by the landowner, and the variance, if granted, would not <br />alter the essential character of the neighborhood. Economic consideration alone shall not <br />constitute an undue hardship if reasonable use of the property exists under the terms of thu <br />ordinance. Undue hardship abo includes, but b not limited to, inadequate access to direct <br />sunlight for solar energy systems. <br />1.
