Box 66 <br />Orono, MN 55323 <br />-J / 199/ <br />RE; Site Plan Review <br />2505 and 2507 Kelly Avenue <br />Dear Ms. Van Zomeren: <br />As the assignee of the purchase agreement between John Bessesen and the fee owner, Peter <br />Chow, I am requesting the following approval. <br />As you know the subject property presently is used as a duplex. The existing structure, it is my <br />understanding, was originally a fire hall and has long since been converted to a duplex. The <br />building is very close to Kelly Avenue and represents a blight condition. Also, the proximity to <br />the roadway causes undue traffic hazards due to turning maneuvers in and out of the driveways. <br />It also represents a visual obstiaxtion and diminution to the neighborhood as it's appearance is not <br />keeping with the adjacent homes. <br />The zoning code for the subject lot is single family and the code allows for a duplex to be <br />constructed within that zoning district. It is my understanding that there is a restriction that the <br />lot be located within 200 feet of commercial and this lot does not meet that perimeter. However, <br />I do not see the logic or the nexus of this distance as it relates to the use for duplex. Further, the <br />property is currently used as a duplex. It also suffers a significant hardship that is unique to this <br />property in the existence of an outlot that is for the benefit of the two adjacent duplexes located at <br />Navarre Cove. Originally, the developer anticipated the construction of three twin homes on <br />three lots. It appears as though the outlot located on our property intended to serve the <br />association and all three docks for the three lots are located on our property. We believe a more <br />fitting solution would be locate each of the property's docks on their lake frontage and will <br />explore this possibility with the neighbors Due the existence of this easement this property is not <br />suitable for a single family residence. <br />MINNEAPOUS • TAMPA <br />DEVELOPMENT • CONSTRUCTION • MANAGEMENT • INVESTMENT
