Applicant ’s surveyor to determine if a Type <br />2 or 3 wetland exists at southwest comer of property adjacent to lakeshore. The <br />City's wetland maps located a protected area in that portion of the property. This <br />wetland should be designated as a drainage easement on the plat. <br />Dedication on the final plat of drainage and utility easements along exterior lot <br />lines and 5' along all internal lot lines. <br />3. Dedication of 33' of right-of-way for Brown Road. <br />4. Applicant to provide a written statement concerning removal of existing <br />structures that encroach required setbacks from newly defined division line. The <br />Planning Commission recommended that accessory structure on Lot 2 must be <br />removed within one year of the date of Council ’s approval of the final plat. <br />Applicant has advised that he is not sure whether the existing residence structure <br />would be removed. If the residence structure is removed, the City will require <br />the removal of the pool. Applicant must take the necessary steps to protect any <br />unwanted trespassers from any hazards created wdth the presence of the pool on <br />a property where no one resides at residence. Applicant may wish to cover pool <br />with boards or other suitable cover to prevent any mishaps. <br />The status of the existing residence and pool must be resolved before the application can be <br />presented to the Council in order to determine the need for granting any setback variances. <br />Council may take the position that if the pool and residence structure are to remain that lot line <br />can be realigned so that both structures meet the required 75 ’ setback from the newly defined <br />east lot line. A written statement concerning the status of all structures on the property should <br />be submitted no later than Tuesday, December 5th before Noon.
