Definition 65 - "Subdivision" lists three types of property separation which are <br />exemptions from the subdivision code. This proposal does not meet any of the three <br />exemptions. However, per Definition 66, "Subdivision Classification", it appears to <br />meet the Class I subdivision definition because it is a division of property previously <br />combined for tax purposes, and therefore is exempt from platting. <br />Summary of Request <br />Conley Brooks has sold the property at 905 West Femdale to John Brooks, and apparently has <br />an agreement with John Brooks to allow the detachment of the peninsula extending westward <br />from 905 West Femdale, for combination with Conley Brooks’s new residence at 980 West <br />Femdale. Conley Brooks has provided a description of his request, stating reasons for the <br />proposed division/combination. This is an extremely unusual request because the peninsula is <br />physically connected to 905 West Femdale, and is completely separated by a lagoon portion <br />of Lake Minnetonka from 980 West Femdale.
