Note that the only Orono protected wetland within the shoreland boundaries for this <br />project is the filling adjacent to Painter's Creek where it flows under County Road 6. <br />Issues for Consideration <br />1.Is the proposed filling of City protected wetlands justified by the health, safety and welfare <br />needs of the community served by this project? <br />2.Does Planning Commission have a concern about the loss of 1/2 acre of wetlands without <br />any assurance that mitigation will happen within a similarly situated watershed draining to <br />Lake Minnetonka? <br />3.Will the proposed fill have any negative impacts on the alTected properties that could be <br />resolved on site i.e. for instance, is there any merit in expanding these wetlands on site to <br />accommodate the filling? <br />4. Does Planning Commission have iny concerns regarding the overall nature of the project? <br />Staff Recommendation <br />Given that this project is in the public interest and given that it appears the applicant has attempted <br />to minimize the impact on wetlands while balancing the needs and desires of the affected property <br />owners, staff recommends approval subject to the following: <br />1, City Engin^'er to review storm water impacts of wetland filling. <br />2. Subject to review and approval by all agencies having jurisdiction. <br />3.Subject to adherence to the erosion control plan as presented and use of Best Management <br />Practices during all phases of construction. <br />4.Subject to applicant obtaining land alteration permit from the City of Orono prior to <br />commencement of the project. <br />5. Su‘ ject to any other conditions Planning Commission feels are appropriate, <br />i
