10. The granting of the application is necessary for the preser\ ation and enjoyment <br />of a substantial property right of the applicant. <br />The applicant is interested in improving the condition of the deck by reducing the size <br />to allow sunlight into the lower level. <br />11. The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to the intent of the Zoning Code. <br />The variance will not impair health, safety, comfort or morals. <br />12. The granting of such variance will not merely serve as a convenience to the applicant, <br />but is necessary to alleviate demonstrable hardship or difficulty. <br />The applicant needs to provide testimony regarding the need to further encroach into <br />the side yard setback requirement and the desire to angle the deck which further encroaches <br />into the average lakeshore setback and the lakeshore setback. <br />Issues <br />1.This lot does not meet lot area, lot width or side yard requirements. The existing <br />deck encroaches 5' into the required lakeshore setback. At least half of the residence is <br />located forward of the average lakeshore setback due to the adjacent structure being located <br />more than 170' from the lakeshore. <br />2. The lakeshore yard slopes down to the lake. <br />3. The deck and retaining walls are in need of maintenance. <br />. 1 <br />I' ’ <br />4. The applicant is proposing to remove hardcover in the 0'-75' and 75 ’-250 ’ setbacks. <br />5. Previous variances have been granted for this property. (See resolution #2324). <br />STAFF RECOMMENDATION <br />Advise the applicant to verify hardcover calculations for the driveway and sideway. Identify areas <br />where there is plastic under the landscaping. Discuss further encroachment into 75' lakeshore <br />setback and required side yard.
