Vacation of Dedicated Public Roads and Park <br />Zoning District; LR-IB, Single Family Lakeshore Residential, 1 acre, sewered. <br />Lbt of Exhibits <br />A - Survey/Staff Sketch <br />B - V^’cation Application <br />C - Revised Variance Application <br />D - Notice of Planning Commission Action 7/31/97 <br />E - Hardcover Request Correction <br />F - Memo and Exhibits of 7/16/97 <br />Revisions to Original Application <br />This item was tabled at the July meeting to allow applicant to revise and amend the application. <br />Applicants have formally applied for the vacation of dedicated public right-of-way and park, and <br />have revised their variance application to include lot area and width as well as hardcover for the <br />proposed layout. <br />Vacation of Road and Park Areas <br />After reviewing the right-of-way issue. Public Works and Zoning staff concluded that the existing <br />40 ’ right-of-way for Spruce Place should not be vacated, but the dedicated roadway east of the park <br />between its north and south extremities, could be vacated. This results in the City retaining its <br />ability to relocate Spruce Place further north and off of the property to the south of the park, if that <br />becomes necessary for some reason in the future. While there is no intent to move Spruce Place, the <br />fact that it is partially encroaching on th'? property to the south suggests that the City should leave <br />its options open. This reduces the size of the area to be vacated to approximately 9,000 s.f., which <br />is still larger than the 7,000 s.f. portion of Lot 5 and vacated Portland Place to be dedicated back to <br />the City.
