The amount of hardcover proposed in the 0-75' setback <br />represents 4.06% of the lot area in the setback. The applicant is also proposing to add hardcover in <br />the 75-250' setback, however, no variance is required. <br />STATEMENT OF HARDSHIP <br />The applicant has indicated that the house was built in front of the adjacent properties. The applicant <br />states that the proposed improvements will not impact the sight lines of either adjacent property. <br />The applicant notes that on the survey ?he deck and stairway appear to be farther than 75' from the <br />lakeshore because of the topography. <br />Criteria for Determining Undue Hardship <br />1.The property in question cannot be put to a reasonable use if used under conditions allowed <br />by the official controls. <br />The property can continue to be used for residential use without the improvements. The <br />applicant should provide testimony as to the reasonable use of the structure without the <br />improvements. <br />2.The plight of the landowner is due to circumstances unique to his property not created by the <br />landowner. <br />n2243 John D.
