Agreement No. PW 52-08-96 CSAH 15; C.P. 9222 In conjunction with this Project, the City Street known as the "Ferndale Cutoff" located right of Engineers Station 10+500 will be abandoned. The City shall contribute the entire City right of way for "Ferrdale Cutoff" to achieve 0.56 acre of constructed wetland in order to mitigate a portion of the City’s share of the impacted DNR wetlands. Due to the limited amount of right of way available within the construction corridor of the Project, the County will provide 0.56 acre of constructed wetland at an off site location to match the City’s contribution. In order to fulfill the total wetland mitigation of 1.84 acres required for this Project, the remaining 0.72 acres of wetland mitigation will also be constructed off site. The City shall participate in fifty (50) percent of the cost of the right of way required for this additional construction, as shown on iuid Exhibit "A". The City shall reimburse the County for its share in the construction costs of the contract work for said Project. The total final contract construction costs shall be apportioned as set forth in the attached Division of Cost in said Exhibit "A". It is understood that the Engineer’s Estimate referred to on Page 1 of this Agreement is an estimate of the construction costs for the contract work on said Project and that the unit prices set forth in the Contract with the successful bidder and the final quantities as measured by the County shall govern in computing the total final Contract construction cost for apportioning the cost of said Project according to the provisions herein. VII In addition to payment of the City’s proportionate share of the contract construction costs, the City also agrees to pay to the County a sum equal to e'ghteen (18%) percent of the amount computed as the City’s share of the contract construction costs for the Project. It is understood that said additional payment by the City is its proportionate share of all engineering costs incurred by the County in connection with the work performed under this Agreement.
