f
%
REQUEST FOR COUNCIL ACTION %Qc>
DATE: November ^H§96
^ •
ITEM NO,\
Department Approval:
Name Michael P. Gaffron
Title Assl. Planning & Zoning Administrator
Administrator Reviewed:Agenda Section:
City Administrator
Item Description: Lafayette Ridge Tax Forfeit Property
List of Attachments
A - 919196 Letter from Bruce W. Palmer
B - 4/23/96 Letters to John Larson and Terry Schuler (Hennepin County Tax Dept.)
C - Staff Memo 12/8/94
D - Plat Map/Topog/Overlay
E - Copy of Special Assessment Levy • County Road 15 Street Lights (1990)
F - Street light location map
Bruce W. Palmer, representing the Lafayette Ridge Homeowners Association (LRHA), requests
that the City release tax forfeited Outlot C, Lafayette Ridge to the LRHA, and that the City waive
the street light assessments levied in 1990.
Outlot C is a wetland and open space commons parcel created by the PRD plat of Lafayette Ridge
in 1978. Outlot C was intended to remain in the ownership of a homeowners association as
density credit for this subdivision.
The parcel went tax forfeit in August 1994 for reasons discussed below, and the LRHA lost its
right to redeem as of August 1995. Because of this and based on State Statutes, according to Gary
Hoecherl at the Hennepin County Tax Forfeit Department, the City has only a limited number of
options to help the Association reclaim the property:
1.
2.
3.
Release the property for sale to adjacent landowners only, since it is
unbuildable.
Activate the City's Housing and Redevelopment Authority and have the
HRA purchase the property for sale to the LRHA.
Apply to the County for a cancellation of the forfeiture based on an
incorrect method of special assessment, i.e. assessment of an outlot rather
than the bencfitted homestead lots.
