B. The proposed improvement will not result in further extensions into the <br />substandard yard areas <br />C. The vacant lot to the immediate rear of property is legally combined with <br />developed homestead parcel to immediate south and will not be <br />developed as a single family residence. <br />D. The property is served with sewer. <br />E. The area and width of this property is consistent with developed lots to <br />the immediate south and southeast of property. <br />F. The property is located immediatei; west of the City's Old Crystal Bay <br />Road park <br />G. The City has received no negative comments from property owners <br />notified of the proposed improvements requiring setback variances. <br />4. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety <br />and welfare of the community <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings and hardships, the Orono City <br />Council hereby grants variances to Municipal Zoning Code Sections 10.03, Subdivision 2 and <br />10.25, Subdivision 5 (B) to permit construction of a partial second story over the existing <br />residence and grants a 3' or 30% separation setback variance, a 21' or 42% rear setback <br />Page 2 of 4
