ORDLNAiNCE NO., SECOND SERIES <br />AN ORDINANCE RELATED TO NOISE CONTROL <br />AN ORDINANCE REPEALING; Ordinance No. 22, Second Series, Sub. 1(N), adopted <br />March 10, 1986, and entitled "Shows and Large Assemblies"; Section 7.14, adopted April <br />1, 1984, and entitled "Honking Horns"; Section 7.30 Sub. 2(1) and (K) and Sub. 5(A), <br />adopted April 1, 1984, entitled "Recreational .Motor Vehicles (Including Snowmobiles)"; <br />Section 9.20, (1), (3) and (7), adopted April 1, 1984, and entitled "Disorderly Conduct"; <br />Ordinance #51, Second Series, (8), adopted May 9, 1988, entitled "Disorderly Conduct"; <br />Ordinance #51, Second Series, Sub. 1(A), adopted May 9,1988, entitled "Public Nuisance"; <br />and Ordinance No. 108, Second Series, (A), adopted August 24, 1992, entitled <br />"Participation In Noisy Parties or Gatherings". <br />The City Council of Orono ordains: <br />CHAPTER 9 OF THE MUNICIPAL CODE ENTITLED PUBLIC PROTECTION, CRIMES <br />AND OFFENSES IS HEREBY .AMENDED BY THE ADDITION OF THE FOLLOWING <br />SECTION: <br />SECTION 9.58 NOISE CONTROL <br />1.Definition. Except as provided in this section, words or phrases used in this chapter and <br />defined in the rules of the Minnesota Pollution Control Agency Noise Section, Chapter <br />7010, shall have the meanings given in those rules. <br />A. A-Weighted. A specific weighing of the sound pressure level for the purpose of <br />determining the human response to sound. The specific weighing characteristics <br />and tolerances are those given in American National Standards Institute 1.4-1983, <br />Section 5.1. <br />B. Cut-Out or By-Pass. Mechanism which varies the exhaust system gas flow so <br />as to discharge the exhaust gas and acoustic energy to the atmosphere without <br />passing through the entire length of the system including all exhaust system sound <br />attenuation components. <br />C. dB (A). A unit of sound level expressed in decibels (dB) and A-weighted, <br />D. Exhaust System. Combination of components which provides an enclosed flow <br />of exhaust gas from engine parts to the atmosphere. <br />E. Holiday. Any day fixed by the United States or by Minnesota State Law for <br />suspension of business in whole or in part.
