5. <br />A <br />B. <br />The propert>' does not have a garage. <br />The proposed garage is located in the approximate footprint of a former <br />garage that was razed in the 1960's <br />The applicant does not have an outdoor seating area at either grade <br />upper level of lakeside of the residence. <br />D The setback of the proposed detached garage would be consistent with <br />the pattern of development of the surrounding properties and immediately <br />adjacent properties <br />The desire to save two mature trees within the street yard has determined <br />the location of the detached garage. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district, that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty, is necessary to preserv'e a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Sections 10.03, Subdivision 14 (C), 10.22 <br />Subdivision 2 and 10.25, Subdivision 6 (B) to permit the construction of a 22' x 26' detached <br />garage and two level 7' x lO'/z" deck at the southwest comer of residence resulting in an <br />Page 2 of 4 <br />J
