Regional conditions: <br />1. Projects which would cause a loss (as described in 26.c., above) or <br />more than three acres of waters of the U.S. are not authorized by this <br />nationwide permit. <br />2. The notification requirements outlined at C. 13. below apply if the <br />project would cause the loss (as described in 26.c. above) or more than <br />cne-half acre of waters of the U.S. <br />3. This nationwide permit is not valid for any project that would cause <br />a significant, adverse modification of more than 10,000 square feet of wetland <br />adjacent to and within 1,000 feet of a lake or wetland that is greater than 10 <br />acres in size, as designated by the Minnesota Department of Natural Resources <br />"Public Waters/Wetlands Inventory" maps. <br />4. This nationwide permit is not valid for any project which is located <br />in waters, or in wetlands adjacent to and within 1,000 feet of waters, that <br />are defined as any of the following: <br />a. Outstanding Resource Value Waters in Minnesota Rules, Chapter <br />7050. <br />b. Trout streams as designated in Minnesota Department of Natural <br />Resources Com-missioner' s Order 2450 Part 6262.0400 subpart 5. <br />c. Trout lakes as designated in Minnesota Department of Natural <br />Resources Commissioner's Order 2450 Part 6262.0400 subpart 3. <br />A list of the above waters is attached. <br />5. None of the nationwide permits are valid for regulated activities in, <br />or in water or wetland areas which arc within 1000 feet of a boundary of, a <br />calcareous fen designated by the Minnesota Department of Natural Resources and <br />listed in Minnesota Rule 7050. A list of these calcareous fens is attached. <br />Section 401 conditions: <br />1. Projects which include dredging in contaminated or polluted areas or <br />that will disturb known contaminated sediments or polluted substances as <br />defined and as listed by MPCA are not authorized under Section 404 by any <br />nationwide permit unless the applicant applies for, and is granted, a <br />project-specific Section 401 certification from MPCA. <br />2. Projects which involve utilization of fill or bank stabili7.ation <br />material which is comprised of demolition debris are not authorized by any <br />nationwide permit unless the applicant applies for, and is granted, a <br />project—specific Section 401 certification from MPCA. Demolition debris is <br />defined by Minnesota Rules Chapter 7035.0300 Subp. 30 as solid waste resulting <br />from the demolition of buildings, roads, and other man-made structures <br />including concrete, brick, bituminous concrete, untreated wood, masonry, <br />glass, trees, rock, and plas\Lc building parts.
