Butterfield tvill allow <br />access throusth his property and create the ponds for the Applicant, and in turn, he would <br />receive the peat material for use in his business. <br />The method of removal would be with a 1/2 yard backhoe, or 3/4 yard *m extreme <br />conditions, and moved by three dump trucks, one 10-yard and mo five-yard. The holes <br />would be 6’ deep and 50’ in diameter Butterfield would drive over the wetland ponds <br />after it has frozen in the winter time, dig the material, and pile it on his property for use m <br />spring as potting material. This method is presently being used on his adjoining property. <br />The DNR has sent literature on construction of wildlife ponds and how to rid them of reed <br />canary grass and obtain aquatic vegetation. No DNR permit is required. <br />Perkins said the ponds will have a slope of 5.1 at six foot depth. The ponds wiU be <br />touched up after each dig^g. <br />A letter from neighbors, James and Patricia Todd, were entered into the record which <br />save their support of this plan. Letters from the MCWD and DNR state no need for <br />permits fi-om their agencies The U.S .Army Corps of Engineers authorized the work <br />under conditions stipulated in their letter via a nationwide permit. <br />Lindquist moved. Smith seconded, to approve Application #1982 for Daniel Perkins with ^ <br />conditions listed by City Staff and to include a yearly land alteration permit issued by Staff <br />for excavation of peat. The excavation is not to exceed 200 cubic yards each year and <br />must be performed during winter. Mr. Perkins is responsible for any safety problems. <br />Ayes 3, Nays 0. <br />(#6) #1983 TOM AND ^LAUREEN PALM, 1685 CONCORDIA STREET - <br />VARIANCES - PUBLIC HEARING 8:25-8:40 P.M. <br />The Certificate of Mailing and Affidavit of Publication were noted. <br />The Applicants were present. <br />Mabusth reported the AppUcation is for a lakeshore setback variance required for a second <br />stoiy addition, an average lakeshore setback variance and hardcover variances. The <br />existing house and addition is 24x50’ located 39’ from the lakeshore where 75' setback is <br />required. The struaure will encroach the average lakeshore setback by 10’. There wiU be <br />no additionrl hardcover, but 28% exists in the 0-75’ setback where O' is allowed, and 33% <br />e.\ists in the 75-250' setback where 25% is allowed. The home is 20’ wide and meets the <br />side setback requirement. <br />5
