Request for Council Action continued <br />page 2 of 3 <br />November 6, 1996 <br />Zoning File #2184_______________ <br />Description of Request <br />Applicant has obtained a building permit for construction of a new residence to be located to the rear <br />of his 3+ acre parcel. The existing residence located approximately 115' from the road right-of-way <br />and 150' in front of the principal structure is structurally sound. Applicant wishes to maintain <br />structure for storage and work shop use. Modification «^f structure is shown on floor plan, Exhibit <br />E. Applicant has asked to retain heating system but all plumbing and plumbing fixtures will be <br />removed. The existing w'ell shall be retained for irrigating of lawn and plantings. Structure will not <br />be used as a second residential unit. The 500 s.f. structure meets all other required setbacks for <br />accessory' st-ucture. Applicant will be asked to execute a restrictive covenant to be filed on the chain <br />of title noting structure can never be used as a second residential unit for either rental or guest house <br />use, refer to Exhibit G. <br />Statement of Hardship <br />Please refer to Exhibit B. Hardships are rev iewed as follows: <br />1 New residence structure will be located approximately 54' trom the rear lot line of a lot that <br />is 380'+ deep. <br />2 ability to use a structure in good condition and one that has been regularly maintained. <br />3 The accessory structure is located 115' from the street right-of-way and is consistent with the <br />setback of other residential structures in area. <br />4. Structure has historical significance as former Wolsfeld home built in 1910. <br />5. Extensive tree coverage between accessory structure and proposed house will prevent <br />persons from viewing second residence at rear of property. <br />Planning Commission Recommendation <br />Planning Commission recommended unanimous approval of the variance as proposed that would <br />allow existing residence to remain as a storage building/accessory structure on the property to be <br />located 150' in front of the front line of the new residence to be constructed. Approval of the <br />variance is subject to the following conditions: <br />1. All plumbing and plumbing fixtures shall be removed. Applicant shall retain a well/spigot <br />for outside yard use. Heating system shall remain to serve applicant when workshop is <br />in use.
