Charles L Kramer, 2990 Somerset Lane <br />to ensure adequate distance is maintained from wetland area The engineer's report <br />recommends a 26' setback This is a setback required for all land alterations adjacent to <br />protected wetlands of the City Staff recommends that the protected wetland within the <br />northern portions of Lot 2 be staked in the field to ensure the minimum 26’ setback from <br />proposed fill (review Exhibit G) Septic test sites on Lots 2, 3 and alternate on 4 must be <br />staked prior to any earth movement. <br />Staff found the wetland located in the northwest comer of the property to be severely degraded <br />and would not classify the wetland as a Type 7. Creation of open water area within the low <br />retention area would create an upgraded wetland along with benefit to varied species of <br />wildlife. <br />The wetland located within the street yard is of more concern for staff The wetland has been <br />classified as a "high quality Hardwood swamp", review Exhibit K. Review Exhibit J, the DNR <br />informatioii lists several species of wildlife that benefit from this type of wetland John Smyth, <br />an aquatic specialist at Bonestroo, has been asked to review the proposal He advises that this <br />is a true Type 7 wetland and shows no sign of degradation and that these are rare and should <br />be protected The creation of an open water area would not raise the value of this wetland <br />There are several mature trees within the wetland. Based on the design specs provided in the <br />alteration plaa Exhibit G, it would appear that the majority of trees would be eliminated. Staff <br />has discussed this concern with Mark Gronberg and he noted that it is applicant's intention to <br />attempt to save the trees with the creation of an irregular pond for the purpose of encouraging <br />other forms of wildlife <br />Planning Commission Recommendation <br />Based on Smyth's strong recommendation to save this wetland, the Planning Commission <br />recommended against any dredging or disturbance of the "Hardwood Swamp" in the southeast <br />corner of applicant's property They approved the dredging of an open water area in the <br />wetland at the northwest corner and placing of spoils on Lot 3 only - no filling is approved <br />within Lot 2 Prior to the land alteration, the wetland on Lot 3 must be staked and septic <br />systems on Lots 3 and 4 fenced off from construction vehicles. It shall be applicant's <br />responsibility to maintain adequate erosion control until ground cover is restored to entire <br />disturbed area Applicant to provide detail on final slopes of banks of the pond. Per MCWD <br />permit, the wetland plantings are to be seeded at a minimum WA' width around the edges of <br />the pond. <br />Applicant is encouraged to plant appropriate species of tiees within Hardwood swamp at <br />southeast corner of property and, if desired, remove the buckthorn stand between road and <br />wetland but this must be conducted under close supervision and direction of Orono staff <br />I
