Ms. Jeanne Nabusth <br />March 22, 1996 <br />Page 2 <br />MUSA Line Extension <br />We understand that final City permission to <br />commence const**uction of this project depends on the Met <br />Council's approval of a comprehensive plan amendment which <br />extends the MUSA line to cover our site. <br />If, however, that amendment continues to be <br />delayed, we ’«^ouid like to be investigating with the city <br />whether there are any approaches under which we could still <br />commence construction. <br />Wetlands <br />Our architectural and soils engineering firms tell <br />us that the watershed district has finally determined that <br />there is some technical wetlands on our site, and we have <br />reconfigured the parking lot (as shown on the site plans <br />included in the application) to avoid that wetlands area. <br />That reconfigurea parking produces approximately <br />100 spaces. We have committed to the school District that <br />we will continue to work on the wetlands and parking issues, <br />and we expect to be helped in that regard by pending <br />legislation which will loosen wetlands requirements in <br />situations like ours. Our aim will be to return the parking <br />capacity to the 130 stalls which we had originally <br />programmed. <br />Ownership of Improvements <br />We are planning to hive the arena improvements <br />owned by a separate non-profit corporation, which will <br />operate technically as a Section 509(a)(3) supporting <br />organization under the Internal Revenue Code. <br />That entity will support Orono Hockey Boosters, <br />Inc., itself a Section 501(c)(3) organization. As a <br />supporting organization, the <ar«*na entity will have a <br />majority of its board of directors (three of five) appointed <br />by Orono Hockey Boosters. Our current thinking is to have <br />the School District and the City appoint the other two board <br />members, and establish an official property owners' liaison <br />position. <br />That arena entity will, in turn, hire a <br />professional arena manager or management firm. <br />School District Lease <br />We have commenced the process of documenting the <br />actual lease agreement with the School District, with
