4. V <br />Said grant ol $175,000 by Lessor is contingent upon completion by Lessee at <br />Lesseeās sole expense of the construction and erection of the arena and parking lot <br />described in section 7 of this Agreement within six (6) months of the Commencement <br />Date (as defined below). Lessee agrees that in the event of a failure, for any reason other <br />than labor dispute, fiie, unusual delay in deliveries, unavoidable casualties or other causes <br />beyond Lessee's control, to complete the erection and construction of the arena and <br />parking lot in accordance with the plans and specifications referred to in section 7(A) of <br />this Agreement within six (6) months, of the Commencement Date (as defined below). <br />said grant shall be revoked and shall be repaid to Lessor within thirty (30) days. Lessee <br />further agrees that the failure to complete the erection and construction of the arena and <br />parking lot in accordance with the plans and specifications referred to in Section 7(A) of <br />this Agreement by December 31, 1997 shall, regardless of the reason for such failure. <br />cause said grant to be revoked and to be r epaid to Lessor within thirty (3) days. Lessee <br />agrees to pay all legal fees and costs associated with efforts of Lessor to recover said <br />grant. <br />3. TERM <br />The term of this Agreement will be a period of 30 years, commencing on the <br />Commencement Dale, as defined below, and ending on a date thirty (30) years hereafier. <br />Lessee may, at the expiration of the initial term, and at its sole option, renew this <br />Agreement for a period of 25 years.
