1. <br />2. <br />3. <br />4. <br />5. <br />6. <br />Owner shall remove 1.488 s.f. of hardcover from the 75-250 ’ zone as indicated <br />on Exhibit A attached. Final 75-250 ’ hardcover is approved at a level of 6,752 <br />s.f. or 24.3%, including approximately 35 s.f of new decks to be constructed as <br />shown on Exhibit A. The owner is advised that any future hardcover additions <br />on the property which result in 75-250 ’ hardcover of more than 25.0%. will be <br />considered a violation of the zoning code unless a variance for such excesses is <br />gVanted. <br />Owner shall obtain an after-the-fact building permit for the gazebo (no penalty <br />fees will be assessed) and the inspection department shall review the construction <br />of the gazebo and may require any modifications necessary to bring that <br />structure into compliance with the building and fire codes. <br />Owner shall obtain a permit for the proposed deck additions as shown on <br />Exhibit A, prior to their construction. <br />Authorities granted by this variance run with the property not with the applicant <br />or current owner, but are permissive only and must be exercised by application <br />for a building permit within one year of the date of Council approval, or this <br />variance will expire on that date (September 23, 1997). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a <br />misdemeanor. <br />The undersigned owner has read, understood and hereby agrees to the terms of <br />this resolution and on behalf of himself, his heirs, successors and assigns, hereby <br />agrees to the recording of this resolution in the chain of title of the property. <br />Page 4 of 6
