Building & Zoning Administrator <br />Date: <br />Subject: <br />September 10, 1996 <br />#2171 Minnegasco, a division of NorAm Energy, 530 Old Ciystal Bay Road <br />North - Renewal Conditional Use Permit - Public Hearing <br />Application: In 1995, the City granted a one year conditional use permit to allow Minnegasco <br />to continue the temporaiy use of a portable vaporizer providing an additional gas <br />resource to the northwest Lake Minnetonka area. Minnegasco had originally <br />asked for a five year extension (original five year CUP issued in 1990). <br />Applicant has filed for an additional one year extension with the hopes of <br />permanent withdrawal from the facility in the spring of 1998. The following <br />ordinances are pertinent for the current review: <br />1.Section 10.50, Subdivision 3 (A-7) - Conditional use permit required for <br />public ser\’ice structure within Industrial zone. Minnegasco proposes the <br />continued use of portable liquid natural gas vaporizer to inject gas into <br />the distribution . 'stem during periods of high demand within winter <br />months. <br />2. <br />Required setbacks: <br />A. Street setback adjacent to residential zone <br />Required = 75' <br />Proposed = 75'+ <br />B. Rear setback <br />Required = 50' <br />Setback from rcar/east property line = 100' <br />C. Required side yard setback (VA times the height of the tank at <br />approximately 15') <br />Required = 22.5' <br />Side setback adjacent to residential used portion of industrial <br />property = 40' from tank to truck location <br />Residential used structure on subject property is over 260’ from <br />proposed operation. <br />Section 10.61, Subdivision 5 (C) - Vehicle parking areas must meet 5' <br />side and rear setbacks and 20 ’ street setback.
